COMPASS BANK (BBVA) why are you lying to the STATE of ALABAMA?

Now HUD, I wrote a letter to the STATE OF ALABAMA.  Yup I sure did!~

Mostly because COLORADO remains one of the Jurisdictions where issues surrounding MERS and Securitization issues are as yet UNDECIDED on the Appellate Level.

Now HUD the State of Alabama was AWESOME, Cylenthia Jones, Consumer Affairs Specialist, wrote me back after researching my questions.  I wanted to find if the assignment recorded in Douglas County was the same she had for the BANK BBVA COMPASS in Alabama.  You know cause….I’m interested. . .

Robin Pruitt Jones,Notary  MERS ROBIN PRUITT JONES   Click on link      Has a position in MERS which I think maybe important.  Because she signed the ASSIGNMENT on Jan 14th and January 16th,2009 from BBVA COMPASS Bank to OLD REPUBLIC  Insurance/Equity Credit.

However, The STATE of ALABAMA, Consumer Affairs Specialist, said after her review, BBVA assigned to OLD REPUBLIC Equity Credit on 2/23/2009 and 3/6/2009  when Old Republic Paid to BBVA these claims, the Note, Mortgage, and Deed of Trust were assigned to them.

HUD, the Assignment of DEED OF TRUST happened in Jan 2009, and was recorded in Apr and May 2009 in Douglas County BUT OLD republic didn’t pay until Feb and Mar of 2009

So here’s my Question HUD……How can BBVA assign my Deed of Trust in January 2009 but Old Republic not PAY for the NOTE/Mortgage and Deed of Trust until Feb and Mar of 2009?

And on page 6 of my Deed of TRUST it says NO ASSIGNMENT:  notwithstanding any other provisions herein to the contrary, each party signing below agrees not to assign any of the party’s rights or obligations hereunder.

See HUD I filed for Chapter 7 in Dec of 2008 and I was wondering why Compass bank was the Owner still when I was discharged 3/10/2009.  Compass Bank was the one in my file ( and notified for the meeting of Creditors)  So is that INSURANCE FRAUD?  

HUD really?   I’m thinking January comes BEFORE Feb and Mar on a Calendar last time I checked!

BRING IT!!!!   Will SOMEONE….ANYONE…..TAKE a STAND here and DO SOMETHING!!!!!!

PNC BANK “We Don’t do FRAUD”….ugh yeah you DO!

HUD, when you talk to your “CHILDREN” and you are handing them MONIES (ie TARP FUNDS, or INCENTIVES for loan Modification through FHA, or when you make them WHOLE by paying them after a foreclosure because the HOUSE was insured)….well you MIGHT want to teach them HOW TO LIE better in court!

I’m just saying. . .when for example PNC BANK, is wanting to foreclose on someone… you may want to tell them or their LAWYERS (ie MEDVED) that the evidence they bring before a JUDGE is “supposed to support their LIES” not prove the DEFENDANT CORRECT?

Well this Petitioner’s Exhibit 2 for example.  HUD when a Plaintiff (A plaintiff (Π in legal shorthand), also known as a claimant or complainant, is the term used in some jurisdictions for the party who initiates a lawsuit ) brings evidence into a court room and they are initiating the lawsuit, well proof of a LOAN MODIFICATION would be rather like saying, the DEFENDANT is Correct your HONOR!

On page 3 of Exhibit 2 was presented to the Honorable Judge Paul King during my Rule120 hearing.  That pg 3 clearly shows that on 9/14/2010 there was an ADJUSTMENT of $10,720.93  and my loan went from $140,283.01  to $151,003.94.  Now HUD, I may not be the BEST math student, in fact when I received my Master’s Degree it was in Public Administration (UNC).  Did you know that?  Yes HUD, I happen to be an Educated HOMEOWNER!

HUD, I thought I would provide you with the policy and procedures for FHA modifications, so you can “discipline your child, PNC BANK”.

  • Lender must ensure first-lien status of the modified mortgage.  In satisfying this requirement, the lender must comply with any applicable state or federal laws and regulations.  I’m just sayin. . . .
  • The Lender is responsible for ensuring that the modification documentation preserves the first lien status of the FHA INSURED LOAN.  (it looks like  they tried to do this by putting OLD REPUBLIC INSURANCE 2nd lien, on the BACK SIDE of the mortgage adding 9 years to the life of my loan.)
  • Allowable provisions,fixed rate loan,fully reinstate the loan,FORECLOSURE costs,LATE FEES,and other admin expenses may not be CAITALIZED, they can get monies in a the form of a repayment plan lump sum,etc SEPERATE from and subordinate to, the modification agreement.

Well hud, those are the Biggest VIOLATIONs from PNC in summary form but there are more.  I’m just sayin. . .

HUD here’s the FRAUD, well a portion of it anyways. . . . PNC Letter Dated May 10,2012  Said, yes in fact there was a Loan Modification, Aug 27,2010 approved (lawyer’s exhibit 2)  But OOPS well PNC didn’t really approve that LOAN MODIFCATION, “they were unable to approve loan modification Jan 2012”.

HUD is that like the BANK asking for a DO-OVER?  You know how children play games and ask for a “DO-over”?

HUD I am trying to keep a SENSE of HUMOR here but this is VERY STRESSFUL!  Could you please make an ARREST and put  PNC BANK BEHIND BARS!

The Bank is not above the LAW.  When does a HOMEOWNER EVER get a DO-OVER?  NEVER, they loose their home,etc.  WAKE UP!

UPDATE JUNE 16,2012  got another  LETTER from PNC letting me know that YES, they are gathering information.  Well it sure is taking you along to to figure out how to AVOID FRAUD charges!  Still freakin waiting!

UPDATE:  YES HUD It’s July 25,2012…I have not recieved Much   further news  from ALL the agencies I have contacted. The State of Alabama did respond and that was helpful about BBVA and COMPASS bank. . . . The Attorney General is reviewing 3 counties foreclosure files and The Govenor has asked for 9 Public Trustees to resign….that’s about it.

BRING it!    I am SOOOOOO very READY!  BRING IT !!!!!!!!!!!!!!!

HUD Project Heritage. . .NON-Profit are you kidding me?

Hud, now seriously. . . in what World is Project Heritage non-profit?  Are you FREAKING kidding me?

 

A nonprofit organization (NPO) is an organization that uses surplus revenues to achieve its goals rather than to distribute them as profit or dividends. States in the United States defer to the IRS designation conferred under United States Internal Revenue Code Section 501(c), when the IRS deems an organization eligible.[1]

While not-for-profit organizations are permitted to generate surplus revenues, they must be retained by the organization for its self-preservation, expansion, or plans.[2] NPOs have controlling members or boards. Many have paid staff including management, while others employ unpaid volunteers and even executives who work with or without compensation (occasionally nominal).[3] Where there is a token fee, in general, it is used to meet legal requirements for establishing a contract between the executive and the organization.

Designation as a nonprofit and an intent to make money are not related in the United States. This means nothing can be conferred by the declaration. It is unclear whether or not this holds outside of the U.S. In the United States, such inference is the purpose of the Internal Revenue Code, Section 501(c). The extent to which an NPO can generate surplus revenues may be constrained or use of surplus revenues may be restricted.

10/25/2006 The Denver Post updated an article about Project Heritage.  Key points:

  • Project Heritage non-profit founded by the church,faulted for “SQUEEZING” too much profit out of a government program to help low-income families buy renovated homes.
  • State REP. Debbie Stafford,R-Aurora, a former Heritage assistant Pastor.
  • Project heritage has a IRS LEGAL TEAM to ensure IRS Compliance.
  • predominantly BLACK fellowship of churches
  • Early in 2000, the church took out a $1 million loan and purchased a seven-seat Hawker Sliddeley DH.125-400A jet built in 1969,according to FEDERAL Aviation Admin. records.
  • on 28 properties that needed a total of $8,000 in renovations, Project Heritage charged $870,000 more than what it had paid HUD for the homes.

So HUD the purchase price included the following ITEMS… well not really see my house doesn’t and NEVER had these:  Air conditioning,tv antennas, burglaralarm,securitydevices,PLANTSMIRRORS?,INTERCOM systems?, kitchen appliances?, Sprinkler system (HAHA HA),Vacuum systems (including accessories ok are you FREAKING kidding me here in FOUNDERS VILLAGE?  1,200 sq ft house)  storm windows, storm doors, awnings?, blinds nope NOT ONE WINDOW COVERING, curtain rods, drapery rods, garage door openers HAH HA,Storage sheds, 2 remote controls.

SO Hummm I received NONE of those items!  I was told to sign this BILL OF SALE by David R. McFann, Executive Dir. Project Heritage.  I needed a house so I signed!

Now HUD, M & T Mortgage said I “wanted” Credit Life Insurance,Credit Disability Insurance, and well BOTH Credit life and Disability Insurance.  Not really sure how BOTH, is any different than each one?  HUD, can you check on those for me….see I never got those but looks like I “WANTED” them and paid for them?  Hummmmm

My House had USED Appliances with Black Mold under the tiles in the kitchen.  Appliances broke in the second and 3rd year.  Had to replace Hot water heater in the first 6 months.  AND I still have original furnace that could go out at anytime.  NO sprinkler system ( I had that installed front and back),etc.  You get the picture!

The WILD WILD WEST. . . ahhh you gotta love those KIDS of your HUD …NO?

VIOLATION of PERMANENT INJUNCTION

So HUD, aren’t you getting tired?  I sure am!  I have been trying for 3 years to have a Lien for $15,000 removed from my Title that has been recorded in Douglas County Clerk and Recorder.

Do BANKS think they are ABOVE the LAW?  HUD, why is it that I must follow the LAW but BANKS DO NOT have to?

Violation of Permanent Injunction is a SERIOUS matter with Judges and the United States of America Bankruptcy Court.  GOOD TO   KNOW!  Well HUD, YES Compass bank,BBVA Compass, Old Republic Insurance and OH YES LCS financial are all in VIOLATION of SEC 5249(a)(2) and (3) of the bankruptcy Code ,it operates as an INJUNCTION against an “ACT” to collect a debt as personal liability of the debtor.

“If you buy goods using a VISA or MASTERCARD credit provided by a lender other than the Seller you get FREE and CLEAR title to the goods even if you discharge your liability on the credit card Free and CLEAR of any security interest in favor of the SELLER.”

So HUD, the McClures won over $152,500.00 and attorney fees for this case.  I could take Compass Bank, BBVA Compass, Old Republic, and LCS Collections to Court because they are ALL CLEARLY in violation of my RIGHTS. . . . but instead…..I am trying to make a POINT HERE HUD….HOMEOWNERS in DISTRESS are not deadbeats.  I could go to court, most likely WIN and have money in my pocket.

Stawiarski JR. esq  Oh I see he’s a LAWYER “of Counsel” of Castle Stawiarski,LLC.  HUD Castle Stawiarski is the “POWERFUL” Foreclosing group here is Castle Rock, they do over 1/2 of all foreclosures in my town.  Plus in this BLOG you can read about the “MONIES” they give the the PUBLIC TRUSTEE, who is impartial by the way, and well they are OWNERS in the Computer software system that they use.

HUD I would think,that a LAWYER like Stawiarski would KNOW the law?  Than why can LCS financial be “allowed” to VIOLATE my PERMANENT INJUNCTION for 3 years?

I have instead FILED COMPLAINTS all over the Freaking place (regulator agencies for banks,etc.)  In hopes that SOMEONE will listen.  I will wave my rights to prosecute to the fullest extent of the law in return for them to remove BOTH LIENS on my property. 

Yup,  CHEAPER for them to do so.  Clearly they are in violation, with a CASE recently won and making a STATEMENT, which of course I WOULD LOVE to do.

We shall see if my efforts will work or I will have to take them to court HUD!  That’s a SERIOUS VIOLATION by the WAY!!

BRING IT! . . . cause that is how the MIDDLE CLASS roles!

BBVA COMPASS and OLD REPUBLIC seriously!

HUD so I was “thinking” maybe I should check into these banks?  I emailed Kim Mitteness (Compass Bank Here in loan Tree)  and she replied with the following EMAIL!

I called the 1-800-239-1996  for Customer Service for BBVA  COMPASS, I wanted to know when my Loan was Transferred?  Loan Number 4355760001328691  and it’s an automatic system.  You just punch in the loan number to get information which OF COURSE I did!

HUD what to my surprise did I find out.  My loan was CLOSED and CREDITED on March 26,2009  for the amount of $15,358.16 

NOW remember my chapter 7 discharge was on March 10,2009  So  BBVA Compass closed my account knowing it was a revolving account (UNSECURED).

The problem is that the DEED of TRUST Recorded in Douglas County Clerk and Recorder has a LOAN NUMBER of 4355760001183898 for $15,000

Are you KIDDING ME!  HUD seriously…. you mean to tell me that a BANK can not get their LOAN NUMBERS straight?  Plus they get to screw up my Title as well?

When I call 1-800-239-1996  and enter into the loan number 4355760001183898 it says no record at this time!  Interesting no?

Well HUD looks like Denver County is how can I say this kindly. . .Missing some Data.  Well like take 2001.  5 homes were purchsed from Sec of Housing and Urban development but than 6 homes from Project Heritage to well FOLKS were Warranty Deeds?

Plus well there may be a GLITCH in the system because most of the data in DENVER comes out line to line.  The warranty deeds well have spaces in them.  Kinda intersting NO?  Those Kids of your HUD, I tell ya.  Project Heritage sure does grant alot of DEED of TRUST to BANKS?  I’m just saying. . .

Ya know HUD, maybe that’s how those million dollar notes got lost?  I know paperwork can be cumbersome, Just balancing a check book can be tuff.  I would expect more from BANKS though wouldn’t you?

Wasn’t it National City Mortgage that went “Belly up”  so to speak and was bought by PNC BANK with Tarp Funds?  I  thought I rememberd reading that somewhere….OH YEAH,  HUD PNC is the bank trying to foreclose on my HOUSE. 

They forgot to tell Douglas  County  Clerk and Recorder about the LOAN MODIFICATION but they made sure to tell you HUD, well so they could get paid.  Would have been nice if they told ME!~

This was the FIRST, yes VERY FIRST meeting of the Public Trustee’s Association E Business Committee.  SO glad it was held at the Douglas County Events Center ….well in my Town! 

You know HUD, E Business KINDA reminds me of well MERS.

People have learned a lot about MERS, but in general we haven’t really focused on what it all means. In short, it means that the mortgage industry decided that it was above the law.

MERS was set up thoughtlessly, without regard to its basic legality, and designed with only two objectives: lowering the mortgage industry’s costs and maximizing its convenience. As a result, MERS has none of the advantages of the centuries-old system it was intend to replace, and largely has. MERS is not accurate, not transparent, and not accountable to the public. To let MERS continue simply allows it to continue wreaking havoc on property records and the legal morass it’s created to continue tangling foreclosure and bankruptcy cases nationwide.

HUD let me tell you about the HONOR system in COLORADO…Seriously did you NOT learn anything from the HUD scandals of 1989????

NOW HUD,  Looks like LCS Financial, CEO Leo Stawiarski, has ties maybe to well….County trustees,MERS,Castle and Stawiarski you know Colorado’s most PROLIFIC ForeClosure Attorneys, COMPASS BANK aka BBVA Compass is a trade name for Compass Bank,National City Mortgage and oh yeah MEGABANK which I think was bought by COMPASS BANK.

MY HOUSE is worth $143,000 according to the Douglas COunty Public Trustee and yet there was a 161,000 first loan with M and T Mortgage, than National City Mortgage, than PNC BANK.  PLUS Compass bank has a deed of trust for 33,000 and they happened to put a deed of trust from a revolving line of credit for 15,000 (not sure how they managed that one since the Trustee in DENVER and the JUDGE said it was a UNSECURE debt. 

The MATH…..drum roll is….$209,000 on a 143K home in FOUNDERS VILLAGE.  My house has less than 1200 sq ft.  How’d they manage that?  OH in case you are thinking, I spent 33,000 well think again because when I spoke up in 2006 regarding Project Heritage I got hit with that TAX LIEN of $34,000 that I had to pay some how?

Let me just say, BUSH and Jack Alphonso I have a Great memory and my files are ALL OVER THE FREAKIN place!    Kinda like in the RULE 120 hearing, it really didn’t matter what the PNC officer said on the PHONE to my question.   Either way he was SCREWED :

SO BRING IT . . . . . . it will not Matter!    Just BRING IT!!!!!!

That is how the MIDDLE CLASS ROLES!  and oh we Role baby!

ASSIGNMENT of Mortgage good to KNOW!!

A new report by Oppenheim Law reveals “the Black Magic of Securitized Trusts”. The largest key to REMICs is that they are required to be passive

vehicles, meaning that mortgages cannot be transferred in and out of the trust once the closing date has occurred, unless the trust can meet very limited exceptions under the Internal Revenue Code. I.R.C. §860G. The 90 day requirement is imposed by the I.R.C. to ensure that the trust remains a static entity. However, since the mortgage-backed securities trust controlling documents, the Pooling & Servicing Agreement (PSA), requires that the trustee and servicer not do anything to jeopardize the tax-exempt status; PSAs generally state that any transfer after the closing date of the trust is invalid.

What does that mean to the average homeowner in foreclosure? Check the recordation office and look for the “Assignment of Mortgage” on your property – generally found just before the Notice of Foreclosure is filed with the State if your loan was securitized. Looking through hundreds of these beauties there have been few, if any, that were timely assigned to the trusts. How can you quickly tell if the Assignment of Mortgage has failed to make it timely to the trust?

The Assignment of Mortgage [below] shows a 2006 Trust – and a fraudulent assignment in 2009 – 3 years AFTER the Trust had CLOSED! Not only was it too late – but the Trust could not accept it pursuant to the REMIC of RFMSI 2006SA4 PSA and as further defined in the Oppenheim Law report. Assignments of Mortgage are public documents.

What was not known until very recently, in fact Delaware Attorney General Beau Biden brought it out in his case Delaware v. MERS, lenders generally failed to follow the PSA and properly assign the mortgage loans to the Trusts. In the transcripts that AG Biden cited from In re Kemp, 440 B.R. 624, 626 (Bankr. D.N.J. 2010) (No. 08-18700) (Aug. 11, 2009), an employee for Bank of America responsible for servicing the securitized Countrywide mortgage loans testified under oath that Countrywide did not have a practice of delivering original documents such as the note to the Trust and was not in the habit of endorsing notes at the bottom, but favored allonges that they made as they went along. She further testified that allonges are typically prepared in anticipation of foreclosure litigation, rather than at the time the mortgage loans are purportedly securitized. Both of these facts are contrary to the requirements of the PSA that the note be endorsed in blank and delivered to the trustee at the time of securitization.
